First, digital instruments can mime to "go out of tune and waveform" warmth these days, as randomly as analog and no one can tell the difference.
Second, everything sounding exactly as it does in 1976 Oxygene belongs to Dreyffus, and if played or copied, must pay them rights (soundtrack and mechanical), and pay Jarre authorship rights.
If Jarre commited fraud to EMI, he only risks a broken contract for putting at risk the company reputation for lying, unless money is involved, where then he may face a criminal charge for damaging someone else's property, which is partly, a public crime, hence, serious - he has not stolen anything, but fraud goes down the same way if you get depicted of your money for nothing.
But it's not what I see here. Neither fraud nor good faith, but the same "gamble" as in T&T, easy money, little work, perhaps won't be noticed... but it's taking away Dreyffus last source of real money... Jarre's early work.
Third, concerts should go ahead, for commercial reasons, and Jarre needs the money, in case he looses... although I do believe it won't be under EMI... but someone needs that recorded for DVD purposes... who will own the rights?
Jarre stretched the rope too damn much and it broke, he is now sailing away... the only thing that may save him is favourable currents.
