Jean Michel Jarre Shares His Perspective on Creators Rights - 25 June 2015

President Jean-Michel Jarre’s keynote speech from CISAC’s recent General Assembly in Brussels has been reproduced as an editorial in this week’s edition of Music Week. Jarre takes a strong stance in favour of the creators’ position on fair remuneration.

Beginning with a recollection of his pioneering 1981 concerts in China, Jarre observes just how far the country has travelled in copyright protection as the two biggest players in the domestic on-line market call for stronger IP protection.

They understand that in order to develop a competitive online environment and an online market that continues to develop for the benefit of everyone, you first need to protect creators. They really get it.

As there is still a long way to go to deliver the same message in the US, Europe and other regions where copyright/authors’ rights are being challenged, Jarre calls upon other creators to make their voices heard and for digital services to get on-board to agree “fair-trade” conditions for the creators that fuel their value streams.

“This is the fight for our future and for the future of the next generations of creators,” said Jarre.

Creators Defend Rights in Works of Art Located in Public Places - 1 July 2015

CISAC President and Vice-Presidents have written to the President of the European Parliament, to express their views on discussions concerning the use of works of art located in public places.

Jean Michel Jarre, Angélique Kidjo, Javed Akhtar, Marcelo Piñeyro, and Ousmane Sow expressed concerns with respect to the proposal of Pirate Party MEP Julia Reda to allow the use of photographs, video footage and other images of works which are permanently located in public places, without the prior authorisation of the creator and irrespective of the commercial nature of such uses. The proposal, which was originally included in MEP Reda’s report to the Legal Affairs Committee from January this year, was later revised to exclude commercial uses of such works without prior authorisation. This revision triggered an aggressive campaign against the amendment and against the interests of creators of public art.

In the letter, the creators called the European Parliament to safeguard the rights of authors against the erosion of the value of their works in favour of a limited number of big commercial stakeholders, who are building global businesses and amassing significant profit on the back of the authors’ community. They encouraged the European MEPs to adopt a decision that would take into consideration all interests involved, at its upcoming plenary session on 9 July.

Yes he is absolutely right, but it will be hard to stop the "legal theft" of creative products.
Who knows already that everyone who logs in to Facebook that FB used not only personal data, passes and recovered, but automatically creations like photos, Videos and ... ? ... also Google (and maybe Twitter and others.....) CISAC can`t do anything. Only the people, by logging out.

CISAC President underlines the need for new business models to sustain creativity and cultural diversity

This interview with Jean-Michel Jarre by journalist, Augustin Trapenard has been translated from French.

On the occasion of the upcoming release of his new album, CISAC’s President Jean-Michel Jarre was the guest speaker on France Inter’s Boomerang, one of France’s leading cultural radio programs. Jarre responds to questions regarding the impact of technology on cultural change, the importance of IP and the need to create new economic models to sustain creativity and cultural diversity in the 21st century.

Do you think that we protect artists enough in this current climate of fast-paced cultural change?

“Music, like other forms of art, such as cinema, video games, literature or theater, has never been made so readily available. Never in the past have we listened to so much music; it has never generated so much money. Yet, creators and artists have never received so little."

Does this threaten the future of cultural and creative industries?

“Intellectual property, like ecology or the environment, is at the foundation of our society. Aside from money, today, we are the smart part of smart phones.
In every family, there is a child, a boy or a girl, who dreams to make music, or to become a photographer, a film director, a playwright or a writer. Today, this individual is forced to take a job to pay the bills and, tomorrow, he or she is likely to have to give up his or her dream. We need to find a balance: in a way, we’re all virtual shareholders in Spotify, Apple and all these other tech companies that make a lot of money out of our artistic content.”

What needs to be done in terms of legislation to ensure the sustainability of creators’ remuneration?

"It’s very simple: on every smartphone, laptop or other electronic device, there should be a small, or even a tiny amount, that is redistributed to creators. This would solve the problem. I’m confident that it will happen. The people who created Apple, Facebook or Spotify were originally kids with a passion for music, and they still love music and other forms of art. They are not our enemies. In 20 years, their businesses have become economic powerhouses. We need to all sit down together to create a new economic model that will sustain creativity and cultural diversity in the 21st century. It is our responsibility for future generations.”

The French musician is widely credited with sparking the synthesiser music boom in the 1970s with his breakthrough 1976 album Oxygene.

He is also a keen follower of the latest technology and is adamant artists need to keep up with the times, and now he has urged his contemporaries to stop blaming the Internet for the demise of the record industry.

As an example of how stars can still have influence, Jarre cites the recent case of Taylor Swift forcing Apple bosses into a U-turn on their policy not to pay musicians royalties during a trial period for clients.

"I think everyone in the music industry should stop whining and stop considering the giants of the Internet as the enemy," Jarre tells Mojo magazine.

"We are the virtual shareholders of these giant companies. When you see Taylor Swift make Apple change their policy, it's proof that we can find solutions - and we will. We need to recognise that artists aren't a luxury; they're one of the fundamental elements of our society."
